In Pero v. Norfolk S. Ry., Co., No. 3:14-CV-16-PLR-CCS, 2014 WL 6772619 (E.D. Tenn. Dec. 1, 2014), the court rejected defendant's software license argument and declined to require plaintiff to view the at-issue video at Defendant’s counsel’s office or to obtain a license for the proprietary viewing software. It reasoned that “Rule 34 clearly envisions that the responding party will bear reasonable burdens in producing discoverable materials in its possession.” It ordered the defendant to either produce a laptop with the video loaded on it for Plaintiff’s use in the litigation or to reimburse the plaintiff for the cost of a software license. NightOwl Discovery White Paper – Seed Sets: The Disclosure Debate

In the US at least, arguments about the use and acceptance of technology-assisted review (TAR) seem to be moving from whether this technology is appropriate to how it is to be used.

The problem with this, or one of them, is that the the debates quickly (and understandably) go over the heads of the lawyers, as technical terms multiply and as apparently conflicting opinions come from different courts in different cases.

David Wallack of NightOwl Discovery has written a paper focusing on one particular difficulty, the disclosure of a seed set’s contents and the inclusion of irrelevant documents while building the sets.

2014 Chief Legal Officer Leadership Forum: David Wallack

David Wallack, General Counsel and Director of NightOwl Discovery, discussed the increasing risk that comes with maintaining too much data and the importance of information-lifecycle governance during his presentation at the 2014 Chief Legal Officer Leadership Forum in Chicago on Sept. 17. In his presentation, Wallack noted general counsels can leverage big data in a number of ways.

According to Wallack, preserving data can be difficult, but general counsels need to understand exactly when they must hold onto data. In addition, Wallack noted general counsels need to learn about big data so they can fully leverage it and bolster their efficiency. By doing so, Wallack pointed out general counsels could avoid a variety of problems down the line: “It is imperative that the legal departments of organizations are aware of big data because companies are going to increasingly rise and fall based upon their ability to analyze and drive value out of it.”

Wallack also noted discovery matters are excellent benchmarks of record-retention policies. With information-governance lifecycles, Wallack said legal departments can effectively store and manage their data: “You can reduce costs by transferring eroding data that’s actually losing context and increasing in risk over time to cheaper-tiered storage methods, while eliminating data that has no value and has lost all of its context. At the same time, you can apply analytics and predictive technologies on incoming data to help categorize that data as it floods in.”

NightOwl Discovery Launches European eDiscovery Centre Of Excellence in Dublin

Dublin, 17th November 2014 –  NightOwl Discovery, a world leader in discovery management, is to establish its European Centre of Excellence for eDiscovery in Dublin, leading to 25 legal and technology jobs over the next three years.

Founded in 1991 and headquartered in Minneapolis, NightOwl Discovery is a provider of eDiscovery services, a process of collecting, preparing, reviewing, and producing electronically stored information (ESI) before legal trials, investigations, or regulatory reviews.

The Irish centre will be NightOwl’s first non-US operations office and will be tasked with providing data operations and review facilities for its European clients. The investment is supported by the Department of Jobs, Enterprise and Innovation through IDA Ireland.

With new offices on Harcourt Road, Dublin 2, NightOwl Discovery’s European Centre of Excellence will focus on providing managed discovery and review services to law firms and corporations, both in Ireland and across Europe. Roles for legal and forensic technology experts will be recruited immediately, in addition to staffing the document review centre with qualified solicitors and barristers.

NightOwl Discovery helps companies and law firms in the most demanding industries manage electronic documents through investigations, disputes, and regulatory reviews. NightOwl Hires Industry Expert as Law Firm Practice Manager

Minneapolis, MN, August 17, 2012 – NightOwl Discovery, a leading national provider of eDiscovery solutions, announced today that it has hired Laura Danielson as NightOwl’s Law Firm Practice Manager. Her primary roles will be as NightOwl’s manager for trial support, trial technology and client training for hosted software solutions such as Concordance, Summation, Clearwell, and Relativity. Laura will also have a leadership role in project management.

Former Twin Cities Chapter Director of Women in eDiscovery and partner at DLS, Danielson brings with her over 22 years of experience in litigation technology and trial support. Having participated in over 100 trials in both Federal and State Courts throughout the country, Laura has experience in all areas of litigation in a variety of contexts. Her background includes litigation paralegal, project management and consulting, and law firm operations management. In addition, Danielson is a published author, a frequent speaker and instructor, and is considered an industry expert. She is a founding member of the Minneapolis-St. Paul Chapter Women In eDiscovery (WIE) and served as Chapter Director 2010-2011. Laura is the WIE National Central Regional Director for 2012-2013, and is a member of the National Board of Directors. Laura is a member of Association of Litigation Support Professionals (ALSP), and the Association of Certified eDiscovery Specialists, and has served on the Board of Directors for the Minnesota Association of Litigation Support Professionals (MALSP).

NightOwl currently has 140 full-time staff. Of the 20 remote workers, most are IT, production management, and customer service staff. Ten of the employees work out of state, including Albert Barsocchini who recently joined NightOwl as Director of Strategic Consulting and works remotely from San Francisco.

Anticipating growth both on site and off, the company is remodeling its 20,000-square-foot discovery facility to add “hot seating,” where staff can change workstations depending upon current project needs. New “computer bars” will accommodate about 20 workers who prefer to stand or sit on a tall stool as they work.

NightOwl expects to add five new project managers and five technicians over the next 18 months. Three of the project managers are likely to work remotely, in regions outside Minnesota, and will probably be paired with three new sales representatives. “As we grow nationally, having employees closer to our customers is critical to our plans,” says Barsocchini.

In the eDiscovery community, “no one spends the day sitting behind a desk pushing paper – the sales team is always in the field, the executive team is on the go, and the rest are knee-deep in the discovery process; so in some ways it is a myth to believe that there is still a traditional office environment anymore,” says Barsocchini.

NightOwl Powers Document Reviews with Predictive Coding Technology

Minneapolis, MN, January 4, 2012 – NightOwl Document Management Services, a leading national provider of innovative eDiscovery solutions, announced today that it has added Relativity Assisted Review technology to its Relativity hosted review service.

When compared to traditional document review, Relativity Assisted Review helps case teams achieve significant time and cost savings by applying text analytics technology to their existing review process. It gives them a means of prioritizing relevant documents, and a way to efficiently delegate or make swift decisions on large batches of non-responsive material.

How Assisted Review Works
Relativity Assisted Review combines technology and process, allowing users to train Relativity on relevant issues by coding statistically sampled subsets of documents. Relativity’s text analytics engine categorizes the remaining documents in the case, based on the small subset of examples. The technology works behind the scenes, so case teams can continue to review documents the same way they always have.

Administrators can validate the accuracy of Relativity’s document categorization by manually reviewing statistically relevant subsets of documents. They can also use reporting tools to gauge review progress and determine whether or not further rounds of review are necessary. Because batches of documents coded by Relativity are randomly sampled using statistical analysis, clients can be confident in their results.
